Terms and Conditions for Tiered Subscription Membership for Recording Studio Rental

These Terms and Conditions ("Terms") govern the use of the recording studio rental services provided by Echo Mountain Recording ("the Studio") through a tiered subscription membership. By subscribing to the membership and using our services, you agree to abide by these Terms.
1. Subscription Tiers
The Studio offers multiple subscription tiers, each with varying levels of access and benefits:
Gold Tier: $75/month.
Platinum Tier: $150/month.
Diamond Tier: $250/month.
The Studio reserves the right to modify the benefits and pricing of each subscription tier. Changes will be communicated to members 30 days in advance.
2. Eligibility
To subscribe to any membership tier, you must be at least 18 years old and provide accurate personal and payment information. The Studio reserves the right to terminate membership if eligibility criteria are not met.
3. Payment and Billing
Subscription Fees: Membership fees for each tier are charged monthly depending on the selected billing cycle.
Payment Method: Members must provide valid credit card or other acceptable payment information to sign up for the subscription. Payment will be automatically charged at the beginning of each billing cycle.
Failure to Pay: If payment fails, access to studio rentals may be suspended until the issue is resolved. After 30 days, the subscription will be terminated.
Cancellation Policy: Members may cancel their subscription at any time. However, no refunds will be issued for partial months or unused hours.
4. Studio Usage
Reservation: Members must book studio time in advance through our booking system. Availability is on a first-come, first-served basis, subject to tier limitations.
Cancellations and Rescheduling: Studio reservations must be canceled or rescheduled at least 30 days in advance. Failure to do so may result in the deduction of reserved hours from your monthly allowance or the charge of a cancellation fee.
Studio Conduct: Members agree to respect the Studio's property and equipment. Any damage caused by misuse or negligence will be the responsibility of the member. A security deposit may be required.
5. Roll-Over and Unused Balance
All Tiers of Members: Balance for studio time must be used within a 5 year period.
Unused Balance: If you have not used any of your studio time within 5 years, your subscription will be paused, and we start deducting a 3% administrative fee each month until you use your studio time.
6. Membership Suspension or Termination
The Studio reserves the right to suspend or terminate a member’s subscription for violating any of these Terms, including but not limited to:
Non-payment
Damage to property
Misconduct
Illegal activities
7. Changes to the Subscription and Services
The Studio may, from time to time, modify the services, pricing, or these Terms. Any changes will be communicated to members at least 30 days before taking effect. Continued use of the membership constitutes acceptance of the changes.
8. Limitation of Liability
The Studio is not responsible for any personal injury, property damage, or loss of data incurred while using our facilities. Members agree to indemnify and hold the Studio harmless from any claims arising from their use of the facilities.
9. Privacy Policy
We respect your privacy and are committed to protecting your personal information. Please refer to our Privacy Policy for more details on how we collect, use, and protect your information.
10. Governing Law
These Terms and any disputes arising from the subscription service will be governed by and construed in accordance with the laws of North Carolina.
